A US Immigration and Customs Enforcement (ICE) agent is facing criminal charges in Minnesota after prosecutors say he pointed a gun at two people during a traffic dispute.

This comes as no charges have been filed in separate attacks on Turning Point USA reporter Savanah Hernandez.

Hennepin County Attorney Mary Moriarty announced the charges Thursday against ICE agent Gregory Donnell Morgan Jr. were arrested in the incident on Feb. 5 on Highway 62 in Minneapolis as part of the broader “Operation Metro Surge” that includes protests and scrutiny in the Twin Cities.

Moriarty “got up, approached the car, matched its speed, opened his window and pointed his weapon directly at both victims,” Moriarty said during the press conference.

According to the criminal complaint, the incident happened around 4:20 pm near the Interstate 35W interchange as traffic was about to reach one lane. Prosecutors say Morgan drove onto the shoulder to pass traffic before pulling the victims over at gunpoint.

Investigators say Morgan was driving a rented SUV that did not have official markings. Both victims said they felt intimidated by his actions, according to the complaint.

Investigators said Morgan was not responding to an emergency at the time and told authorities he was returning to the Whipple Federal Building to finish work to get gas.

Morgan told investigators he feared for his safety, yelled “Police! Stop it,” and believed the men were “torturers” who cut him off because he was a federal agent, according to the complaint.

Authorities have issued a nationwide warrant for Morgan’s arrest. He faces two counts of assault, each of which carries a seven-year prison sentence. Bail was set at $100,000, with conditions including being unarmed and complying with all court appearances.

Moriarty said the case moved faster than other investigations related to Operation Metro Surge because authorities were able to complete their work “without interference or interference.”

“Today’s charges mark a milestone in our accountability efforts,” Moriarty said, adding that his office continues to investigate more than a dozen incidents involving federal agents.

Prosecutors are also reviewing whether to file charges against the people accused of beating Hernandez during an anti-ICE protest outside the Whipple Federal Building last weekend.

Protesters attacked Hernandez while he was reporting, punching horns in his face, yelling obscenities and shoving him as he tried to leave, according to video from the scene.

At one point, a protester pushed Hernandez against a fence, and later another pushed him to the ground as he yelled, “Stop touching me” and “Stop, I’m trying to walk!”
