Judge halts termination of Ethiopia’s TPS, says Trump administration ignored due process

A judge has reversed the termination of the Trump administration’s Temporary Protected Status (TPS) in Ethiopia.

“Plaintiffs brought suit challenging the validity of the termination, alleging that Defendants violated TPS, the Administrative Procedure Act, and the Equal Protection Act. Before the Court is Plaintiffs’ motion to postpone the effective date of the termination pending a decision on merits. Because the Ethiopian Defendants have reviewed the TPS termination process, we will grant Plaintiffs’ motion,” wrote US District Court Judge Brian Murphy. of the State of Massachusetts.

The judge was appointed by then-President Joe Biden in 2024, according to the court’s website.

Last year, then-Department of Homeland Security (DHS) Secretary Kristi Noem issued a notice indicating that Ethiopia’s TPS designation would be terminated effective Feb. 13 at 11:59 pm But that move did not work, as it was blocked amid legal disputes.

“What is important in this case – and in our constitutional system – is the principle that the will of the President does not supersede the will of Congress. The wishes of the president cannot and cannot supersede the legal obligations of the agencies,” Murphy wrote in the April 8 memorandum and order.

“The Constitution requires the President to ‘take care that the Laws be made in good faith,’ a directive that includes enforcing the laws in accordance with congressional orders. And executive agencies granted executive authority by Congress may operate only within the limits set by Congress. However, in this case, the Defendants have disregarded both that basic principle and the statutory scheme established by Congress.

“This suspension of Biden-appointed judge Brian Murphy is just the latest example of legal activists trying to prevent President Trump from restoring integrity to America’s immigration system,” DHS said in a statement provided to CBS News. “Temporary means temporary. The state of affairs – including conflicts – in Ethiopia has developed to the point where it no longer meets the legal requirement for Temporary Protected Status. The Trump administration is putting the American people first.”
